TERMS OF
SERVICE

These Terms of Service govern the provision of 3D printing, 3D scanning and CAD design services by 3Dmatic (ABN 84 260 789 988) to clients in Australia. By placing an order or engaging our services, you agree to these terms.

1. DEFINITIONS

“3Dmatic”, “we”, “us” or “our” means 3Dmatic, ABN 84 260 789 988, with its principal place of business at Level 1/16 McDougall St, Milton QLD 4064.

“Client”, “you” or “your” means the individual or entity ordering services from 3Dmatic.

“Services” means 3D printing, 3D scanning, CAD design, rapid prototyping and any related services provided by 3Dmatic.

“Files” means any digital design files, drawings, specifications or other materials submitted by the Client in connection with an order.

2. ORDERS & ACCEPTANCE

2.1 All orders are subject to acceptance by 3Dmatic. We reserve the right to decline any order at our discretion, including but not limited to orders involving unlawful, dangerous or unethical applications.

2.2 A binding contract is formed when 3Dmatic confirms acceptance of your order in writing (including by email or online order confirmation).

2.3 Quotes are valid for 30 days from the date of issue unless otherwise stated. Prices are in Australian dollars (AUD) and exclusive of GST unless stated.

2.4 3Dmatic may revise a quote if the files submitted differ materially from those used to generate the original quote, or if unforeseen technical difficulties arise.

3. CLIENT FILES & INTELLECTUAL PROPERTY

3.1 You warrant that you are the owner or authorised licensee of all intellectual property rights in the files you submit, and that the production of parts from those files does not infringe any third-party rights.

3.2 3Dmatic will not use your files for any purpose other than fulfilling your order. Your files will not be shared with third parties without your written consent except as required by law.

3.3 Where a mutual Non-Disclosure Agreement (NDA) is signed, the terms of that NDA take precedence over this clause. NDAs are available on request at no charge.

3.4 3Dmatic retains ownership of all production tooling, jigs, fixtures and processes developed internally, even where these are created specifically for your order.

4. DESIGN FOR MANUFACTURE

4.1 3Dmatic will review files for printability prior to production and may advise on design modifications. Any DFM (Design for Manufacture) advice is provided in good faith but does not constitute engineering certification.

4.2 If you choose to proceed with a file that 3Dmatic has flagged as potentially problematic, we accept no liability for any resulting defects, failures or non-conformances.

4.3 3Dmatic does not certify parts for safety-critical applications including medical implants, aerospace structural components or pressure vessels unless expressly agreed in writing with supporting documentation.

5. TOLERANCES & QUALITY

5.1 Dimensional tolerances vary by technology: FDM ±0.3mm, SLA ±0.1mm, SLS/MJF ±0.3mm, DMLS ±0.1mm. These are general guidelines and actual tolerances depend on part geometry, material and size.

5.2 Surface finish, colour and mechanical properties may vary between batches and from digital renderings. 3Dmatic makes no warranty as to exact colour matching unless a specific colour-match service has been ordered.

5.3 Parts are inspected before dispatch. If a part is found to be outside agreed tolerances or contains production defects not caused by the client’s design, 3Dmatic will reprint or refund at our election.

6. PAYMENT

6.1 Payment is due prior to production unless a credit account has been agreed in writing. 3Dmatic accepts EFT, credit card and other methods as listed on our website.

6.2 For orders over $5,000 AUD, a 50% deposit may be required before commencement of production. International orders require 50% deposit and full payment before dispatch.

6.3 Overdue invoices attract interest at 10% per annum calculated daily. Recovery costs are payable by the Client.

6.4 All prices are in AUD and exclusive of GST. GST is applicable to all orders where 3Dmatic is required to charge GST under applicable Australian law.

7. DELIVERY & SHIPPING

7.1 Turnaround times are estimates only and commence from the date of order confirmation and file approval. 3Dmatic is not liable for delays caused by material availability, equipment maintenance, force majeure or courier delays.

7.2 Risk of loss or damage passes to the Client upon handover to the courier. 3Dmatic recommends shipping insurance for high-value orders.

7.3 Shipping costs are additional to quoted prices unless stated. International shipments are the Client’s responsibility regarding customs duties, taxes and import permits.

8. CANCELLATIONS & RETURNS

8.1 Orders may be cancelled prior to production commencement for a full refund. Once production has commenced, cancellations are not accepted and payment remains due in full.

8.2 Returns are accepted only where parts contain production defects confirmed by 3Dmatic. Claims must be made within 7 days of delivery with photographic evidence.

8.3 3Dmatic does not accept returns for parts produced correctly to specification where the Client’s design was the cause of non-performance or non-conformance.

9. LIMITATION OF LIABILITY

9.1 To the maximum extent permitted by Australian Consumer Law, 3Dmatic’s liability for any claim arising from the provision of services is limited to the value of the relevant order.

9.2 3Dmatic is not liable for indirect, consequential, special or incidental loss including loss of profit, loss of revenue, loss of data or business interruption, even if advised of the possibility of such loss.

9.3 Nothing in these terms excludes any guarantee or right that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

10. GOVERNING LAW

10.1 These terms are governed by the laws of Queensland, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of Queensland.
